Biographical

DAVID C. NUTTER  is one of the most sought-after mediators and arbitrators in Georgia. As a Senior Neutral at Miles Mediation, he has successfully mediated over 1800 cases involving commercial disputes, employment litigation, restrictive covenants, contracts and torts, corporate and partnership litigation and dissolutions, real estate, technology implementations, trust and estates, insurance coverage, construction, securities, banking, nuisance claims, false arrest and excessive force cases, and personal injury suits including automobile wrecks and premises liability claims. David also has an active arbitration practice having acted as arbitrator in business and partnership disputes, tort and contract actions, breach of fiduciary duty claims, real estate matters and construction disputes.  David has extensive trial experience, including seven years as an award-winning federal prosecutor in Atlanta, and has had the unusual experience for an attorney of twice being selected to serve on civil juries. He is a Founding Member of the Georgia Academy of Mediators and is a member of the National Academy of Distinguished Neutrals.

Mr. Nutter is a 1983 cum laude graduate of Furman University, and a 1986 magna cum laude graduate of the University of Georgia School of Law where he was admitted to the Order of the Coif and served as Editor-in-Chief of the Georgia Law Review. He clerked for the Honorable Patrick E. Higginbotham, U.S. Court of Appeals, Fifth Circuit, and was admitted to the Georgia Bar in 1987. After serving as an associate at King & Spalding for four years, David joined the U.S. Attorney’s Office in Atlanta as an Assistant United States Attorney where he prosecuted fraud and public corruption cases. During his seven-year tenure as an AUSA, he received the Department of Justice’s Director’s Award for Superior Service as an Assistant United States Attorney (1996) and the Federal Bar Association’s National Younger Federal Lawyer Award for outstanding service to the U.S. Government (1995).

From 1998 until 2005, Mr. Nutter was a partner at the law firm of Nations, Toman, Nutter & McKnight LLP representing plaintiffs and defendants in banking litigation, consumer class actions, professional liability matters, securities litigation, employment litigation, restrictive covenant litigation, construction litigation, trusts and estates disputes, franchise disputes, real estate disputes, corporate litigation and corporate dissolutions.

Since 2005 Mr. Nutter has been a full-time mediator and arbitrator at Miles Mediation and Arbitration Services LLC. 

Mr. Nutter is an AV rated attorney and is a member of the State Bar of Georgia, The Lawyer’s Club of Atlanta, and The Atlanta Bar Association.

Education

In 1983, Mr. Nutter graduated cum laude from Furman University with a B. A. degree. He received a Juris Doctorate, magna cum laude, from the University of Georgia in 1986, where he was admitted to the Order of the Coif and served as Editor-in-Chief of the Georgia Law Review from 1985 to 1986.
